RETURNS & RIGHT OF WITHDRAWAL POLICY

At DAWID TOMASZEWSKI, we want you to be completely satisfied with your purchase. If, for any reason, you are not entirely happy with your order, you may return eligible items in accordance with this Returns & Right of Withdrawal Policy.

This Policy explains your statutory right of withdrawal under European consumer law as well as our return procedures for purchases made through our online store.


1. Statutory Right of Withdrawal (EU Consumers)

If you are a consumer residing in the European Union, you have the legal right to withdraw from your purchase within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party designated by you (other than the carrier), takes physical possession of the goods.

To exercise your right of withdrawal, you must notify us of your decision by means of a clear statement.

2. Effects of Withdrawal

If you validly withdraw from the contract, we will reimburse all payments received from you, including the standard cost of delivery (excluding any supplementary costs resulting from your choice of a delivery method other than our standard delivery option).

Refunds will be made using the same payment method you used for the original transaction unless expressly agreed otherwise.

We may withhold reimbursement until:

  • we have received the returned goods; or

  • you have supplied evidence that you have returned the goods,

whichever occurs first.


3. Returning Goods

You must return or hand over the goods without undue delay and, in any event, no later than 14 days after informing us of your decision to withdraw.

The deadline is met if you dispatch the goods before the 14-day period has expired.

Unless otherwise agreed, you are responsible for the direct cost of returning the goods.

We recommend using a tracked and insured shipping service.


4. Condition of Returned Items

Returned products should be handled with reasonable care.

To qualify for a full refund, items should be returned:

  • unworn;

  • unused;

  • unwashed;

  • free from perfume, make-up or other stains;

  • with all original tags attached;

  • in their original packaging where reasonably possible.

You are liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.


5. Exclusions from the Right of Withdrawal

The statutory right of withdrawal does not apply where permitted by applicable law, including but not limited to:

  • bespoke or made-to-order products;

  • personalised products;

  • sealed goods that are not suitable for return for health or hygiene reasons once unsealed;

  • sealed audio, video or software products once unsealed;

  • products that have been inseparably mixed with other items after delivery.

These exclusions apply only to the extent permitted by applicable consumer protection legislation.


6. Exchanges

At present, we do not offer direct product exchanges through our online store.

If you require a different size, colour or style, we recommend returning the original item (where eligible) and placing a new order.

This ensures the fastest possible processing.


7. Damaged, Defective or Incorrect Items

If your order arrives damaged, defective or incorrect, please contact our Customer Care team without undue delay.

Where appropriate, we may request photographs of the product and packaging to assist in assessing the issue.

Subject to applicable law, we will arrange an appropriate remedy, which may include:

  • replacement;

  • repair;

  • exchange;

  • refund.

Nothing in this Policy limits your statutory warranty rights.


8. Refunds

Once your returned goods have been received and inspected, we will notify you of the outcome.

Approved refunds will be processed as soon as reasonably practicable using the original payment method.

Please note that your payment provider or financial institution may require additional time before the refunded amount appears in your account.
